Terms and Conditions
- Reservation
After making your reservation with us, our
booking form must be duly completed and signed by the
first named person on the booking. This should be the
party leader; he/she must be over21, and authorized by
all members of the party, who are listed on the booking
form, to accept our booking conditions on their behalf.
All documentation will be sent to the party leader, who
should duly apprise the other party members of any information.
Upon receipt of the completed booking form, confirmation
of the booking will be sent to you in writing, please
check carefully to ensure it is correct, if not please
inform us immediately. Our home is booked solely for
the use of those persons named on the booking form unless
agreed in writing with Florida Hills LTD. Once we have
sent confirmation to you, we have a binding contract.
- Villa Occupancy
The villas maximum capacity of 10 persons must not be exceeded in order to comply with the State of Florida regulations. The villa is available for occupancy from 4pm on the day of arrival until 10am on the day of departure. You agree to a) permit the Management Company or their Agents reasonable access to the property to carry out any maintenance if necessary,
b) To take good care of the property and leave it in a clean tidy condition at the end of your stay. No pets are permitted.
- Payment
You are required to pay us a non-refundable
deposit of £200/US$300 per booking; the outstanding
balance is payable 2 months prior to the date of your
first occupancy. If you were to book the villa less than
3 months prior to your date of first occupancy, the full
balance is due immediately.
- Property Deposit
We also hold a refundable property deposit
of £200/US$300, in case of breakage's, loss or
damage to the villa during your stay. This shall be refunded
in full some 14 days after the return of our villa keys,
when we should have confirmation from our management
company that the villa was left by you in the same condition
in which you found it, less any deductions to cover the
cost of replacement or repair. You will also be liable
for any damages in excess of £200/US$300. The Management
Company will be sole arbitrators on cause of damage or
loss.
- If you have to cancel your
holiday
If unfortunately any member of your party needs
to cancel the booking, we would ask that we be informed
immediately in writing. Duly countersigned by the party
leader. Cancellation will be effective from the date
it is received by us. Cancellations are subject to a
charge detailed below as a percentage of the total amount
due dependent on the time you cancel. Cancellation notice

More than 2 months = Deposit only,
2 months to 0 days = 100% of the rental charge For most
reasons beyond your control cancellation will be covered
by your travel insurance. But cancellation due to financial
reasons or no longer wishing to travel is not included
in your travel insurance.
- If we change or cancel your
holiday
In the unlikely event that due to circumstances
beyond our control, we need to make changes to or cancel
your booking, we will inform you as soon as possible.
We reserve the right to cancel any bookings at any time,
and will only be held liable to refund Monies already
paid by you the client. (Including the £200/US$300
security Deposit). In cases of 'force majeure' your booking
may need to be terminated prior to the scheduled conclusion
of your booking. This however is extremely unlikely to
occur although if the situation arises we will not be
able to offer refunds, pay compensation or reimburse
you for any expenses you may incur. Your travel insurance
may cover you for these events.
- Swimming Pool
The property has a swimming pool, which is
thermostatically controlled to approx 82 degrees F
between the hours 9am to 5pm. Please understand that
it is not possible to guarantee the temperature of the
pool which is to some degree is dependant on the local
weather. A pool cover is provided to help maintain the
heat at night during the cooler periods.The pool cover
must be removed before you enter the pool. All
children must be supervised at all times, and also caution
must be taken around wet areas. The owners / management
company do not accept responsibility in the event of
injury or death caused as a result of the use of the
pool. For your safety glass is not permitted in the patio/pool
area.
If any person(s) shall be unable to use the swimming
pool at the villa due to repair or maintenance for a
period in excess of 7 days there will be a refund made
of 5% of the daily rental charge for each day the pool
is unusable. No such refund will apply to a period of
7 days or less. The owners and their agents do not accept
liability for injury howsoever caused, during the use
of the pool and the surrounds of the pool. Guests are
expressly forbidden to allow children to use the pool
without adult supervision. Under the terms of our Florida
state hotel/motel licence, the pool door is alarmed for
the protection of children. This alarm should not be
tampered with and a fine will be imposed if this rule
is ignored. Additionally it is requested that guests
do not enter the villa with wet clothes as chlorine will
damage carpets and furnishings.
- Spa/Hot-Tub
The Spa is Heated 24 Hours a day children must be supervised at all times. You agree to follow the instructions for use supplied with the villa entry pack. The owners and their agents do not accept liability for injury whatsoever caused during the use of the spa.
- Electric BBQ Grill
We have provided an Electric BBQ Grill. Please
be careful when using the equipment and follow the instructions
for use provided with the villa entry pack. We recommend that you place it on a mat before
use. Please clean up any spills straight away. The BBQ
and surrounding area Must be left in a clean and satisfactory
condition. If the management company deem the grill and
area are left dirty an extra cleaning charge will be
made and deducted from your security deposit (min $40).
- Smoking
We have a no smoking policy within the villa/garage.
However, guests may smoke around the pool and gardens.
If it is deemed that smoking has taken place inside the
villa then a charge against your security deposit may
be made.
- Alarm System
The villa has an Alarm System fitted and this should be activated every time you vacate the villa.
- Internet Access
Unfortunately the management or we cannot be held responsible if the service fails. The management company and ourselves will do our up most to try and rectify the situation if notified.
- Telephone Calls
We offer FREE phone calls up to a limit of $10.
$10’s will provide on average
400 minutes - to UK landlines ,
50 minutes - to UK mobiles,
400 minutes - to US & Canadian landlines
If you wish to call any other countries during your stay please contact us first so we can advise you how many minutes are available within the complimentary $10’s. This is offered in good faith for contacting relatives and loved ones back home and we do not expect it to be abused. You will not be asked for Credit Card details when making calls.
- Personal Items
All personal items and valuables are your own responsibility and we will not be held responsible for their security at any time.
- Brochure Description
Whilst all information supplied in the brochure / on the web site
is deemed to be correct and to the best of our knowledge,
it is understood that the information supplied is for
guidance purposes only and does not form part of any
contract.
- Building Work
We cannot be held responsible for any building
work that takes place on or around the sub-division.
- In case of complaint
Things do occasionally go wrong, and we promise
you we shall make our best endeavours to rectify faults
to your satisfaction. You must inform our local management
company immediately in order that the problem may be
rectified as soon as possible. If you are not satisfied
with the solution please make this known to us in writing.
We will not accept liability for any dissatisfaction
or other complaints not reported to our local manager
during your stay.
- Force Majeure
We cannot unfortunately be held responsible
nor accept any liability where we are prevented from
fulfilling our contractual obligations by 'force majeure'.
These include but are not limited to, war, threat of
war, civil commotion or strife, hostilities, strikes
and other industrial disputes, natural disaster, fire,
acts of God, terrorist activities, technical difficulties
with transportation and utilities, closure of airports,
ports or ferries, quarantine, epidemics, weather conditions,
government action or other events outside our control.Your
travel insurance may cover you in some of these events.
- Service Failure
We cannot be held responsible for the failure of public services such as electricity, telephone, gas or water. The failure of internet access or of mechanical equipment such as but not limited to air-conditioning, washing machines, tumble dyers and dishwashers although we would make every reasonable effort to remedy any problems.
- Governing Law
This agreement shall be construed in accordance
with and governed by the law of England and Wales and
each party agrees to submit to the non-exclusive jurisdiction
of the courts of England and Wales.
- Liability
Florida Hills LTD DO NOT ACCEPT LIABILITY FOR
ANY INJURY, DAMAGE OR LOSS SUSTAINED BY ANY MEMBER OF
YOUR PARTY OR ANY PERSON WHO ENTERS INTO THE VILLA DURING
YOUR CONFIRMED RENTAL PERIOD EITHER BY YOUR INVITATION
OR NOT, EXCEPT WHERE ANY PERSONAL INJURY OR DEATH IS
ATTRIBUTABLE TO THE NEGLIGENCE OF Florida Hills LTD.
- Travel Insurance
IT IS STRONGLY RECOMMENDED THAT YOU AND ALL
MEMBERS OF YOUR PARTY TAKE OUT HOLIDAY TRAVEL/MEDICAL
INSURANCE TO COVER CANCELLATION FEES AND ANY OTHER LOSSES
THAT MAY OCCUR. IT IS YOUR RESPONSIBILITY TO ENSURE THIS
IS SUFFICIENT.
